Physical Control
Wis. Stat. 346.63 — to operate is to work any control needed to put a vehicle in motion
Operate. For the section, to operate means the physical manipulation or activation of any of the controls of a motor vehicle necessary to put it in motion.
Drive. To drive means the exercise of physical control over the speed and direction of a motor vehicle while it is in motion.
Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Wisconsin attorney.
