When The School Calls It Bullying
Wis. Stat. 118.46 — every school board's policy, handed to every family each year
Each Wisconsin school board adopts a policy prohibiting bullying by pupils. It may adopt the state's model policy, which includes a definition and a prohibition of bullying, a confidential reporting procedure, a ban on retaliating against a pupil who reports, and an investigation procedure that names who investigates and requires that the parent or guardian of each pupil involved be notified.
Every year, to every family. The board provides a copy of the policy to anyone who asks, and distributes it annually to all pupils in the district and to their parents or guardians.
Discipline itself, suspension and expulsion procedure, federal civil rights law on harassment based on a protected characteristic, and criminal charges for conduct that is also a crime are outside this page. Whether a district followed its own policy in a particular case, and what can be done if it did not, are questions for a licensed Wisconsin attorney.
