Where Nobody May Smoke

Wis. Stat. 101.123 — enclosed places of employment and public places, and the person in charge

Wisconsin lists enclosed places where no person may smoke, and then sweeps in every other enclosed place of employment or public place.

  • Restaurants, taverns, private clubs, retail establishments and lodging establishments.
  • Educational facilities, college residence halls, child care centers and inpatient health care facilities.
  • Theaters, correctional facilities, state institutions, and state and local government buildings.
  • Common areas of multiple-unit residential properties.

Outdoors, in a few places. Within 25 feet or less of a University of Wisconsin residence hall or dormitory, anywhere on a child care center's premises while children receiving care are present, and in the immediate vicinity of the state capitol. Sports arenas, bus shelters and public conveyances are also covered.

The person in charge. No person in charge may allow anyone to smoke in violation of the section at a location under their control, or provide matches, ashtrays or other smoking equipment there.
