A Claim Against the Government
W.S. 1-39-113 — an itemized written claim to the governmental entity within two years
No action is brought under Wyoming's governmental claims act against a governmental entity unless the claim is first presented to the entity as an itemized statement in writing within two years of the alleged act, error or omission. Where the act was not reasonably discoverable within that time, or was not discovered despite due diligence, the action may be brought within two years after discovery.
Who handles this in Wyoming: legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
- The time, place and circumstances of the loss or injury, with the name of the public employee involved, if known.
- The name, address and residence of the claimant and of any representative or attorney.
- The amount of compensation or other relief demanded.
Claims against the state go to the general services division of the department of administration and information. Claims against any other governmental entity are filed at its business office, which for a county is the county clerk and for a city or town the city or town clerk. A local government need not act on the claim before suit.
Whether the act waives immunity for a particular claim is a question for a licensed Wyoming attorney.
