A First Drug Offense
W.S. 35-7-1037 — probation without a judgment of guilt, and a dismissal at the end
For a person with no earlier drug conviction anywhere who pleads guilty to or is found guilty of possession, or of using or being under the influence, the court may, with the person's consent, defer the proceedings without entering a judgment of guilt and place them on probation.
Who handles this in Wyoming: Wyoming State Bar, attorney referrals; and legal aid programs and the state offices, listed in the Wyoming directory.
- A violation of probation lets the court enter the judgment of guilt and sentence.
- Completing it leads to discharge and dismissal, which is not a conviction for disqualifications or for repeat offense penalties.
- A person may receive this discharge and dismissal only once.
