Checking Work Authorization
Ala. Code § 31-13-15 — every employer enrolls in E-Verify, and knowingly hiring an unauthorized worker costs licenses
No employer knowingly employs, hires or keeps on an unauthorized alien to work in Alabama. Every business and employer in the state enrolls in E-Verify and verifies each employee's eligibility through it, and an employer that does so has not violated the section for that employee.
Who handles this in Alabama: legal aid programs, lawyer referral and the state offices, listed in the Alabama directory.
- On a first knowing violation, the court orders every unauthorized worker let go and puts the employer on probation for three years, with quarterly reports of new hires.
- The employer files a sworn affidavit with the district attorney within three days of the order.
- Business licenses and permits for that location are suspended for up to 10 business days.
