Dividing Property and Maintenance
AS 25.24.160 — property acquired during the marriage divided in a just manner, and maintenance without regard to fault
In a divorce the court divides the spouses' property, retirement benefits included, whether joint or separate, acquired only during the marriage, in a just manner and without regard to fault. It may reach property either spouse had before the marriage when balancing the equities requires it.
Who handles this in Alaska: legal aid programs, lawyer referral and the state offices, listed in the Alaska directory.
The court may also award one spouse maintenance from the other, for a limited or indefinite time, in a lump sum or installments, as is just and necessary without regard to fault, based on factors meant to allocate the economic effect of the divorce fairly.
