Getting Divorced, or a Dissolution
AS 25.24.200 — a dissolution when both spouses agree on everything, or a divorce on grounds such as incompatibility
A husband and wife together may petition the superior court for a dissolution of their marriage when incompatibility of temperament has caused its irremediable breakdown, and they have agreed on custody, visitation and support for children under 19, and on dividing their property, retirement benefits and any spousal maintenance.
Who handles this in Alaska: Alaska Legal Services Corporation, apply for help and Alaska Legal Services Corporation; and legal aid programs, lawyer referral and the state offices, listed in the Alaska directory.
The property agreement has to be fair and just, considering the factors the court weighs in a divorce.
- Incompatibility of temperament, cruel and inhuman treatment, or personal indignities that make life burdensome.
- Adultery, or a felony conviction.
- Willful desertion for one year, or habitual gross drunkenness for one year before the case.
- Incurable mental illness after at least 18 months in an institution.
- Addiction after the marriage to opium, morphine, cocaine or a similar drug.
Those are among the grounds a divorce may be granted on when the spouses do not petition together.
