AS 45.45.320 — three repairs of the same defect or 30 business days out of service in the first year
If within the warranty, or one year from delivery to the first owner, whichever ends first, the manufacturer or its dealer cannot make a new vehicle conform to the warranty after a reasonable number of attempts, the manufacturer takes it back and, at the owner's option, replaces it or refunds it.
Who handles this in Alaska: Alaska Department of Law, Consumer Protection Unit; and legal aid programs, lawyer referral and the state offices, listed in the Alaska directory.
- The same defect was repaired three or more times and still exists.
- The vehicle was out of service for repair 30 or more business days in total, leaving out delays beyond the repairer's control.
Either one is presumed to be a reasonable number of attempts.
The notice. To claim a refund or replacement, the owner gives written notice by certified mail to the manufacturer and its dealer or repairer before 60 days have passed after the warranty or that first year ends, whichever ends first.
