Lease Terms That Do Not Count
AS 34.03.040 — no waiver of the tenant law, no confessed judgment, no landlord's lawyer fees, and damages for using them willfully
- Waiving rights or remedies under the landlord and tenant act.
- Letting someone confess judgment on a claim under the lease.
- Excusing or limiting the landlord's or the tenant's legal liability, or making one cover the other's.
- Agreeing to pay the landlord's attorney fees.
Who handles this in Alaska: legal aid programs, lawyer referral and the state offices, listed in the Alaska directory.
A rental agreement may not contain any of these, and a term that does is unenforceable. If a landlord or tenant willfully uses an agreement with terms they know are prohibited, the other side may recover actual damages.
