Calling For An Overdose
A.R.S. 13-3423 — no possession charge from evidence found by calling 911 for help
In Arizona, a person who in good faith seeks medical help for someone's drug-related overdose is not charged or prosecuted for possessing or using a controlled substance or paraphernalia, or a preparatory offense, when the evidence was gained because they sought help. The person who overdosed is not charged with possession or use either.
- Seeking medical help means calling 911 or otherwise contacting police, poison control or a hospital emergency department.
- Seeking help may be a mitigating factor in a prosecution under the drug chapter.
- It does not limit evidence of other crimes, or an arrest for any other offense.
