Protests And Assembly

A.R.S. 13-2902 — present at a gathering bent on riot, and refusing an official order to disperse

Two ways. A person commits unlawful assembly by assembling with two or more others intending to engage in riot, or by being present at an assembly of two or more others engaged in, or with a readily apparent intent to engage in, riot, knowingly remaining there and refusing to obey an official order to disperse. It is a class 1 misdemeanor.

The right to assemble and to speak comes from the state and federal constitutions, and permits for marches and the use of public places are set by local rules; neither is on this page. Whether a particular order was lawful, or a particular gathering unlawful, is a question of fact and law for a licensed Arizona attorney.
