Public Intoxication
A.R.S. 36-2031 — no county or city may make being intoxicated an element of an offense
Not an offense by itself. No Arizona county, city or other political subdivision may adopt or enforce a law that makes being a common drunkard or being found in an intoxicated condition an element of an offense carrying a criminal or civil penalty, and none may apply a general law to get around that.
The same section leaves in place the laws on drunken driving and operating vehicles, boats, aircraft or machinery under the influence, and the laws on the sale, purchase, possession or use of alcohol at stated times and places or by particular classes of persons.
