Turning Eighteen

A.R.S. 1-215 — the age of majority is eighteen years of age or more

Eighteen. As the Arizona Revised Statutes use the words, majority or age of majority means eighteen years of age or more, an adult is a person who has attained eighteen years of age, and a minor is a person under eighteen years of age.

  • A person who is eighteen years of age or older and of sound mind may make a will.
  • A resident who will be eighteen years of age or more on or before the next regular general election, and who meets the other qualifications, is qualified to register to vote.
  • When a pupil with a disability reaches eighteen years of age, the rights the pupil's parent held under part B of the federal Individuals with Disabilities Education Act and under the laws of the state transfer to the pupil, unless the pupil has been declared legally incompetent.

Delegating school decisions. A pupil with a disability who is at least eighteen but under twenty-two, has not been declared legally incompetent, and gives informed consent may delegate the right to make educational decisions to a parent or agent. The delegation is notarized, lasts no more than one year though it may be renewed each year until twenty-two, and the pupil may end it at any time.

Support past eighteen. If a child reaches the age of majority while attending high school or a certified high school equivalency program, support continues while the child is actually attending, but only until the child reaches nineteen years of age. A court may order support past the age of majority for a child with severe mental or physical disabilities, shown by being unable to live independently and be self-supporting, where the disability began before the age of majority.

Ages set for specific purposes elsewhere, such as buying alcohol or tobacco and some licenses and permits, and emancipation before eighteen, are not on this page. How a particular age rule applies to a particular person is a question for a licensed Arizona attorney.
