Who Has To Report It

A.R.S. 13-3620 — the listed reporters, immediately, including a parent of the minor

In Arizona, the persons the section lists who reasonably believe a minor is or has been the victim of physical injury, abuse, a reportable offense or neglect not explained as accidental, or of a denial of necessary medical care, report immediately, electronically or by telephone.

  • The list includes health professionals in the course of treating a patient, peace officers, child safety workers and clergy, school personnel, any other person responsible for the minor's care or treatment, and the parent, stepparent or guardian of the minor.
  • A required reporter with direct knowledge reports to the department of child safety and may not delegate it.
  • A report to a school resource officer or school safety officer does not satisfy the duty.
  • A violation is a class 1 misdemeanor, or a class 6 felony if the failure involves a reportable offense.

What counts as abuse or neglect, the immunity a good faith report carries, and the confidentiality of the reporter are set in other sections and are not reproduced here. In an emergency, the police come first. Whether a duty applied in a particular case is a question for a court and for a licensed Arizona attorney.
