Renting The Lot, Owning The Home
Civ. Code 798.30 — ninety days before a rent increase, and sixty days to sell or remove
Ninety days before a rent increase. Park management gives a homeowner written notice of any rent increase at least 90 days before the date of the increase.
In California, the law gives mobilehome owners in parks protection from actual or constructive eviction, because of the high cost of moving a home, the risk of damage, and the cost of installation and lot preparation.
A listed reason, and sixty days. Management may not terminate or refuse to renew a tenancy except for a reason the article specifies, and on written notice, served as the eviction statute prescribes, to sell or remove the home within a period of not less than 60 days stated in the notice. Copies go to the legal owner, junior lienholders and the registered owner within 10 days.
A homeowner who sells under such a notice pays past due rent and utilities from the sale, and remains subject to the park's rules while the home is still in the park.
