Debt Collectors
C.R.S. 5-16-105 — after 8 a.m. and before 9 p.m., and a written request to stop is honored
- At an unusual or inconvenient time or place; absent other knowledge, a convenient time is after 8 a.m. and before 9 p.m. where the consumer is.
- Directly, once the collector knows the consumer has an attorney on the debt and can find the attorney's name and address.
- At the consumer's job, where the collector knows the employer prohibits it.
Who handles this in Colorado: Bankruptcy Clinic, U.S. Bankruptcy Court for the District of Colorado and Colorado Department of Law, Stop Fraud Colorado; and legal aid programs and the state offices, listed in the Colorado directory.
A Colorado debt collector or collection agency may not contact a consumer about a debt in any of those ways. Once the consumer says in writing that they refuse to pay, or want contact to stop, further communication stops except as the section allows, and the agency's first letter has to say so.
Nor may a collector engage in conduct whose natural consequence is to harass, oppress or abuse anyone, among it threats of violence, obscene or abusive language, publishing lists of people said to refuse to pay, and causing a phone to ring repeatedly to annoy.
