Fla. Stat. 316.0083 — a notice within 30 days, $158, and 60 days to pay, contest or name the driver

The notice. Within 30 days after a violation, a notice is sent by first-class mail to the registered owner, stating the remedies available, that the penalty is $158, and that within 60 days the owner may pay, furnish an affidavit, or request a hearing, to avoid a traffic citation being issued.

The evidence. The notice tells the owner of the right to review the photographs or video, which create a rebuttable presumption against the owner, and where they can be seen. A payment or fee may not be required before a hearing requested within the 60 days.

Right turns. No notice or citation issues for a careful and prudent right turn on red where right turns are permitted, or where the driver stopped completely after the stop line before turning right.

Speed cameras, school bus and school zone cameras, and local ordinances are governed by other provisions or not at all, and are not on this page. Whether a particular notice was issued correctly, and the effect of ignoring one, are questions for a licensed Florida attorney.
