Overtime
HRS 387-3 — one and one half times the regular rate past forty hours in a workweek
No employer may employ anyone for a workweek longer than forty hours unless the hours past forty are paid at no less than one and one half times the employee's regular rate.
Who handles this in Hawaii: Wage Standards Division, Department of Labor and Industrial Relations; and legal aid programs, lawyer referral and the state offices, listed in the Hawaii directory.
- For a weekly salary, the regular rate is the salary, with the reasonable cost of any board or lodging furnished, divided by forty.
- Some seasonal agricultural and food processing employers may skip overtime for up to twenty workweeks a year that they choose, but still pay it past forty eight hours in those weeks.
- Split shifts are allowed only where all the shifts in a twenty four hour period fall within fourteen consecutive hours, except in an extraordinary emergency.
