Disturbing The Peace
Idaho Code § 18-6409 — loud or unusual noise, fighting or threats, maliciously and willfully, a misdemeanor
Maliciously and willfully. Every person who maliciously and willfully disturbs the peace or quiet of a religious gathering, a neighborhood, a family or a person by loud or unusual noise, tumultuous or offensive conduct, threatening, quarreling, challenging to fight or fighting, or firing a gun, commits a misdemeanor.
So does maliciously and willfully disturbing a funeral, memorial service, funeral procession, burial or viewing.
Unless a section sets another punishment, a misdemeanor carries up to six months in the county jail, a fine of up to $1,000, or both.
Speech alone is protected unless it falls into a category the First Amendment does not cover, such as true threats or fighting words. A particular charge is a question for a licensed Idaho attorney.
