Minimum Wage

Idaho Code § 44-1502 — $7.25 an hour, tracking the federal minimum, and $3.35 for tipped employees

$7.25. No employer may pay less than $7.25 an hour, and the state minimum conforms to and tracks the federal minimum wage.

Email

A tipped employee's direct wage may be counted up by tips actually received, but may not be less than $3.35 an hour, and if tips and wage together fall short of the minimum, the employer makes up the difference. In a dispute over tips, the burden is on the employer.

Tips shared through a pool are not counted as the employee's own. The section has exemptions. A particular job is a question for the Department of Labor.
