The Letter About Your Information
Idaho Code § 28-51-105 — an investigation, notice to the affected resident without unreasonable delay, and a fine of up to $25,000 a breach
A business, person or public agency that owns or licenses computerized personal information about Idaho residents investigates promptly and in good faith on learning of a breach, to find out how likely it is that the information will be misused.
Notice without unreasonable delay. If misuse has happened or is reasonably likely, the affected Idaho residents are notified as soon as possible, without unreasonable delay, allowing for the needs of law enforcement and the work of finding the scope and securing the system.
A public agency that learns of a breach notifies the Idaho Attorney General within twenty-four hours.
Intentionally failing to give the notice carries a fine of up to $25,000 for each breach. A particular breach is a question for the Attorney General's office or a licensed Idaho attorney.
