The Theft Ladder
Idaho Code § 18-2407 and Idaho Code § 18-2408 — over $1,000 is grand theft, and petit theft carries up to a year
A person commits theft by wrongfully taking, obtaining or withholding another's property with intent to deprive the owner of it, including by deception, false promise, extortion, keeping lost property without trying to return it, or receiving property known to be stolen.
Over $1,000. Theft is grand theft where the property is worth more than $1,000, or is a public record, a check or other listed kinds, or is taken by extortion. Otherwise it is petit theft.
- Petit theft: a misdemeanor, up to $1,000 or one year in the county jail, or both.
- Grand theft by value and most other kinds: a felony, one to fourteen years or a fine of up to $5,000, or both.
- Grand theft by extortion: a felony, one to twenty years or a fine of up to $10,000, or both.
Those are the penalties. A particular charge is a question for a licensed Idaho attorney.
