When Someone Uses Your Name
Idaho Code § 18-3126 and Idaho Code § 18-3128 — taking another person's identifying information to get credit is a felony
It is unlawful to obtain or record another person's personal identifying information without their authorization, intending it to be used to get credit, money, goods or services without their consent.
A felony. Misappropriating identifying information is a felony, punishable by up to five years in the state prison, a fine of up to $50,000, or both.
Receiving, keeping or disposing of property or cash knowing it was obtained by that kind of fraud is a misdemeanor, carrying up to one year and a fine of up to $1,000. Where the retail value is over $300 it is a felony.
The crime is in obtaining or recording the information with that intent, whether or not credit was ever obtained. A particular case is a question for the police or a licensed Idaho attorney.
