When a Lender Takes the Car Back
810 ILCS 5/9-609 — after default, without court only if there is no breach of the peace
After a default, a secured lender may take possession of the collateral, through the courts, or without them only if it proceeds without breach of the peace.
Who handles this in Illinois: legal aid programs, lawyer referral and the state offices, listed in the Illinois directory.
Where agreed, and in any event after default, the lender may require the debtor to assemble the collateral and make it available at a place reasonably convenient to both.
