Specialized Driving Privileges

Where a court suspends driving privileges, or the bureau suspends them after a failed chemical test, the court may stay the suspension and grant specialized driving privileges, for a period and on terms the court sets.

• The petition is verified, states age, date of birth and address, the grounds and the relief sought, is filed in the case that led to the suspension, and is served on the bureau and the prosecuting attorney.
• A person granted privileges keeps proof of future financial responsibility insurance, carries the order or keeps it in the vehicle and shows it to an officer on request, and carries a state ID or driver's license.
• Someone with a commercial license may not drive a vehicle needing one while the suspension lasts.

A person who tells the court at the initial hearing of an intent to petition has the suspension stayed and a hearing set within 30 days. The petition has to be filed within ten days of the initial hearing, or the stay is lifted and the affidavit goes to the bureau.

A suspension for refusing a chemical test cannot be the basis of specialized privileges, though the court may allow driving with an ignition interlock instead; neither can a suspension for passing a stopped school bus, nor can a person who has never been an Indiana resident.
