What Probation Can Include
IC 35-38-2-2.3 — the conditions come in writing, with when a petition to revoke may be filed
Conditions a court may set for probation include combinations of these.
Who handles this in Indiana: legal aid programs and the state offices, listed in the Indiana directory.
- Working or studying, treatment, a program or class, supporting dependents, and restitution the person can pay.
- Not possessing a firearm without permission, reporting to and allowing visits from a probation officer, staying in the court's jurisdiction, and reporting changes of address or job.
- Community work, home detention, chemical testing, no contact with a named person, and addiction or mental health counseling.
The person on probation receives a written statement of the conditions and of the deadline for a petition to revoke for a violation: the earlier of one year after probation ends or forty-five days after the state learns of the violation.
A court may require jail time as a condition, served in a stretch or intermittently; intermittent service is limited to not more than 60 days in a county or local facility, completed within one year, without good time credit.
