Iowa Code § 901C.3 — a misdemeanor conviction expunged once in a lifetime, after more than eight years

  • The court expunges a misdemeanor conviction on application when more than eight years have passed since the conviction.
  • The applicant has no pending charges, has not had two deferred judgments, and has paid all fines, costs and restitution.
  • It is granted once in a lifetime, though one application can cover misdemeanors from the same occurrence.

OWI, driving while suspended, public intoxication, domestic abuse assault, harassment, stalking, sex offenses, weapons chapter offenses and the others the section lists cannot be expunged this way.
