Iowa Code § 708.2A — a third offense is a class D felony
- A first offense is a simple misdemeanor, or a serious misdemeanor with bodily injury or mental illness.
- It is an aggravated misdemeanor with intent to seriously injure, with a dangerous weapon, or by impeding breathing or blood flow with pressure on the throat or neck.
- A second offense steps up a level, and a third or later offense is a class D felony.
- Impeding breathing that causes bodily injury is a class D felony.
