- Knowingly possessing a controlled substance without a valid prescription or other authorization is a serious misdemeanor for a first offense.
- After a prior drug conviction, it is an aggravated misdemeanor.
- For marijuana, a first offense carries up to six months in jail or a $1,000 fine, or both.
