Signing Over Authority
Iowa Code § 633B.105 — a power of attorney signed and acknowledged before a notary
- A power of attorney is signed by the principal, or in the principal's conscious presence by someone else at the principal's direction who is not a prospective agent.
- It must be acknowledged before a notary or another person authorized to take acknowledgments.
- An agent named in it may not notarize the principal's signature.
- An acknowledged signature is presumed genuine.
