Belongings Left Behind
K.S.A. 58-2565 — abandonment after 10 days behind with belongings gone, and a sale 30 days after storage with notice published 15 days before
If a tenant is 10 days behind on rent and has removed a substantial part of their belongings, the landlord may assume the unit is abandoned unless the tenant has said otherwise.
Who handles this in Kansas: legal aid programs, lawyer referral and the state offices, listed in the Kansas directory.
- The landlord may take what is left, store it at the tenant's expense, and sell or dispose of it 30 days after taking possession.
- At least 15 days before the sale, the landlord publishes a notice once in a county newspaper.
- Within seven days after publication, the landlord mails a copy to the tenant's last known address.
After an abandonment, the landlord makes reasonable efforts to rent the unit at a fair rent. A lease is treated as ended when the new tenancy begins, or when the landlord learns of the abandonment if the landlord does not try to rent it.
