A Suspension Before Trial
KRS 189A.200 — the court suspends at arraignment after a refusal, a prior offense, or a serious crash
- At arraignment, the court suspends the license of a person charged with DUI who refused a test, had a prior offense or refusal suspension within ten years, or was in a crash causing another's death or serious physical injury.
- The person may move for judicial review of the suspension, and the court holds it within 30 days after the motion is filed.
At a review of a refusal suspension, the court continues the suspension during the case if it finds the person was arrested for DUI on reasonable grounds, was advised of the implied consent law, was asked for a test, and refused.
