An offense punishable by confinement in the penitentiary is a felony; by confinement elsewhere, a misdemeanor; by a fine only, a violation.

A felony fine is the greater of the range or double the gain from the offense, and the court weighs the ability to pay. A misdemeanor fine may be added to jail, or stand in place of it.
