KRS 526.010 — one party's consent, and recording others' conversation without it is a felony

Eavesdropping is overhearing, recording, amplifying or transmitting any part of a wire or oral communication of others without the consent of at least one party to it, by any device.

Intentionally using a device to eavesdrop is a Class D felony, whether or not the person is present, and so is installing a device knowing it will be used to eavesdrop.
