Spousal Support
KRS 403.200 — maintenance only for a spouse who lacks property for reasonable needs and cannot support themselves
Kentucky calls it maintenance, and a court may order it for either spouse, but only on two findings: the spouse seeking it lacks enough property, counting the marital property awarded to them, to provide for reasonable needs; and the spouse cannot support themselves through appropriate work, or has custody of a child whose condition makes it appropriate not to work outside the home.
- The financial resources of the spouse seeking maintenance and their ability to meet their needs independently.
- The time needed for education or training to find appropriate work.
- The standard of living during the marriage, and how long the marriage lasted.
- The age and the physical and emotional condition of the spouse seeking it.
- The ability of the paying spouse to meet their own needs as well.
The amount and the length of time are what the court deems just after weighing those factors. The section sets no formula.
