A Mobile Home Lot
La. R.S. 9:3259.1 — when lot rent is 60 days late, the park owner tells the lender in writing
When rent on a lot for a factory built home is sixty days past due, the owner of a park with three or more lots notifies the secured parties, and a mortgagor who does not live in the home, in writing by mail.
- If the owner does not notify within thirty days after the rent is sixty days late, its claim for rent is limited to ninety days of past due rent.
- The owner may charge a $25 fee when it notifies and the lessee or mortgagor then pays.
A home worth no more than $5,000, free of any mortgage or lien, that the lessee has abandoned may be sold to cover the rent, but only after notice to the lessee, a demand for payment of at least fifteen days, a newspaper advertisement, and a court's authorization. The lessee may pay and redeem it before the sale.
