Abuse of an Older or Impaired Adult
La. R.S. 15:1504 — anyone who believes an adult is being abused, neglected or exploited reports it
Any person with cause to believe an adult's physical or mental health or welfare has been or may be harmed by abuse, neglect or exploitation reports it. No one who reports in good faith, or cooperates in the investigation, can be sued for it.
- The adult protection agency investigates promptly, interviewing the adult and visiting the home if possible.
- If it is refused access, it may ask a court for an order granting it.
- An adult who has capacity and refuses services for self-neglect may not be given them.
- The reporter's identity is kept confidential.
Cruelty to an elderly person, sixty or older, or to a person with an infirmity or disability, by intentional or criminally negligent mistreatment or neglect that causes unjustifiable pain or suffering, carries up to $10,000, up to 10 years, or both.
