La. R.S. 40:1151.2 — an adult may declare in writing, before two witnesses, that life-sustaining procedures be withheld
Any adult may make a written declaration directing that life-sustaining procedures be withheld or withdrawn if he has a terminal and irreversible condition. It is signed in the presence of two witnesses. After that diagnosis, a declaration may also be made orally or by other means before two witnesses.
- The declarant notifies the attending physician, and someone else may do so if the declarant cannot.
- The law's illustrative form lets the declarant choose whether nutrition and hydration are withheld too.
- The secretary of state keeps a registry, charges $20 to register a declaration and issue a do not resuscitate bracelet, and $5 to file a revocation.
A declaration may be revoked at any time, regardless of mental state, by destroying it, by a signed and dated written revocation, or by an oral or nonverbal expression, effective once the physician is told.
