Bad Checks

La. R.S. 14:71 — a check written knowing the money is not there, with ten days to pay after notice

Issuing a worthless check is giving one for anything of value with intent to defraud, knowing the account does not have the funds to pay it, or that the account is closed or does not exist.

  • Not paying within ten days after notice of nonpayment is sent by certified mail, or delivered, is evidence of the intent to defraud.
  • Under $1,000, the penalty is up to 6 months, up to $500, or both, with higher grades for larger amounts.
  • Checks written within a 180 day period may be added together to set the grade.
  • The court orders restitution, plus a fifteen dollar service charge for each check.
