The Lease That Rolls Over
La. C.C. art. 2721 — a tenant who stays one week past a fixed term, with no objection, has a reconducted lease
When a fixed term ends and the tenant stays in possession with no notice to vacate or other objection from either side, the lease is reconducted, which is the Civil Code's word for renewed by staying:
- After one week, for a lease with a fixed term longer than a week.
- After one day, for a lease of a week or less.
- After thirty days, for an agricultural lease.
All the lease's provisions continue for the new term, and a reconducted lease is ended by the same notice that ends a lease with no fixed term.
