A Work Restricted License

29-A M.R.S. § 2503 — driving to work during a first administrative suspension

A person under a first administrative suspension for an alcohol level may petition the Secretary of State for a work restricted license. The Secretary of State may stay the suspension and issue one if the petitioner shows by clear and convincing evidence that:

  • A license is necessary to drive between home and work, or within the job, or, for a young driver's first offense, between home and school.
  • No other means of transportation is available.
  • The petitioner has not been under an OUI suspension within 10 years.

The Secretary of State suspends the work restricted license, without a preliminary hearing, for any violation of the motor vehicle title while it is in effect, for breaking one of its conditions, or for not finishing the alcohol and drug program by the end of the suspension period.
