Under 21 and Driving
29-A M.R.S. § 2472 — a provisional license and any alcohol at all, 0.00
A license issued before 21 is provisional for 2 years from the date of issue or until the holder turns 21, whichever comes last. It carries the condition that the holder not drive with an alcohol level of more than 0.00 grams.
Who handles this in Maine: legal aid programs and the state offices, listed in the Maine directory.
Any alcohol, an OUI conviction or driving under the influence of drugs suspends the provisional license without a preliminary hearing: one year for a first offense and two years for a second, plus 180 days when a passenger under 21 was along.
- A moving violation within 2 years of the license's issue suspends it for 30 days on a first offense, 180 days on a second and one year after that.
- That suspension ends only after a driver improvement program. A driver 18 or older may ask for a hearing, and one under 18 has no right to one.
- A driver under 21 submits to a chemical test when there is probable cause of any alcohol.
