Equal Pay
26 M.R.S. § 628 — the same pay for comparable work, whatever the sex or race
An employer may not pay an employee less than one of the opposite sex, or of another race, in the same establishment for comparable work on jobs with comparable skill, effort and responsibility. Seniority, merit and shift differentials that do not discriminate are allowed.
Who handles this in Maine: legal aid programs and the state offices, listed in the Maine directory.
- No employer may fire or discriminate against an employee for invoking or helping enforce the law.
- No employer may forbid an employee from disclosing their own pay, or asking about or disclosing a coworker's, to enforce these rights.
- No employer may ask about a job applicant's pay history, from the applicant or a past employer, until an offer with all its pay terms has been made.
