Being Arrested Without A Warrant

Crim. Proc. § 2-202 — in the officer's presence, or probable cause of a felony

  • Anyone who commits or attempts a felony or misdemeanor in the officer's presence or view.
  • Anyone the officer reasonably believes committed a felony or misdemeanor the officer has probable cause to believe is being committed in the officer's presence or view.
  • Anyone the officer has probable cause to believe committed or attempted a felony, whether or not in the officer's presence.

Those are the three grounds this section gives a Maryland police officer to arrest without a warrant. For a misdemeanor, the section ties the arrest to what happens in the officer's presence or view; for a felony, probable cause is enough wherever it happened.
