Calling For An Overdose
Crim. Proc. § 1-210 — immunity for seeking or giving help in an alcohol or drug emergency
In Maryland, a person who in good faith seeks, provides or assists with medical help for someone reasonably believed to be having a medical emergency after using alcohol or drugs is immune from arrest, charge or prosecution for the possession and underage alcohol offenses the section lists, when the evidence came solely from that help. The person in the emergency has the same immunity.
- Neither may be sanctioned for a violation of pretrial release, probation or parole on evidence found solely because of the help.
- Seeking or giving help may be a mitigating factor in a prosecution of either of them.
