Moving Over For Stopped Vehicles

G.L. c. 89, § 7C — slow down, and change lanes where there are 4, near flashing lights

In Massachusetts, a driver approaching a stationary emergency response vehicle, highway maintenance vehicle or recovery vehicle with flashing lights proceeds with due caution and slows to a reasonable and safe speed for the conditions, and, if practicable on a highway with at least 4 lanes and at least 2 going the driver's way, changes into a lane not next to it.

  • An emergency response vehicle is a fire apparatus, police vehicle, ambulance or disaster vehicle.
  • A recovery vehicle is one designed to assist or tow a disabled vehicle.
  • A highway maintenance vehicle is one owned or run by the state, a county or a city or town, or by a contractor working for one.

A violation carries a fine of not more than $100.
