The Equipment Stop
G.L. c. 85, § 15 — 1/2 hour after sunset, 500 feet, and whenever the wipers are needed
When. A vehicle on a public way has headlights and taillights turned on and displayed so as to be visible from the front and rear during the period of 1/2 hour after sunset to 1/2 hour before sunrise, and at all other times when visibility is reduced so that persons or vehicles on the roadway are not clearly discernible at a distance of 500 feet, or when the windshield wipers are needed.
Stationary too. The section applies to a vehicle whether stationary or in motion on a public way.
Not a moving violation for insurance. A violation is not deemed a conviction of a moving violation for the purpose of determining surcharges on motor vehicle insurance premiums.
An exemption. On the owner's written application with reasons, the department may in writing exempt a vehicle from the section for a period it elects.
Other equipment the code requires, from brakes to mirrors, is set out in other sections that are not on this page. Whether a lamp was out, or the conditions called for lights, is a question of fact, and whether a stop on that basis was lawful is a question for a licensed Massachusetts attorney.
