Late Fees
Minn. Stat. 504B.177 — only if agreed in writing, and never more than eight percent of the late payment
Eight percent at most. A Minnesota landlord may not charge a late fee unless the landlord and tenant agreed in writing that one may be charged and when. In no case may it exceed eight percent of the overdue rent payment.
A late fee is neither interest nor liquidated damages. For a tenancy subsidized under a federal program whose rules conflict, the landlord may follow the federal late fee schedule. Where the government pays part of the rent under a housing assistance contract, a late fee is figured only on the tenant's portion.
