Minn. Stat. 513.55 — every material fact the seller is aware of, in writing before the agreement

In Minnesota, before signing an agreement to sell residential real property, the seller makes a written disclosure to the prospective buyer of all material facts the seller is aware of that could adversely and significantly affect an ordinary buyer's use and enjoyment of the property, or an intended use the seller knows of. It is made in good faith and to the best of the seller's knowledge.

Updates. If the seller learns the disclosure was inaccurate, the seller notifies the buyer in writing as soon as reasonably possible and in any event before closing.

Liability. A seller who fails to disclose material facts the seller was aware of is liable to the buyer for damages and other equitable relief. The action is commenced within two years after the buyer closed the purchase. The seller is not liable for errors outside the seller's personal knowledge, or for what only an inspection of inaccessible areas or an expert would find.

Waiver. The disclosure may be waived if the seller and buyer agree in writing; that does not waive disclosure duties under any other law.
